BRANCHING OUT: THE ORGANIZATION IN THE STATE GOVERNMENT

The prosecution of anyone connected with the organization in Hudson County is very difficult because the governors appoint the county prosecutors and the attorney general. In spite of reams of testimony and hundreds of affidavits no adherent has ever been convicted of an election fraud; a few from time to time have been indicted, and fewer still brought to trial, only to be acquitted. Republican governors have appointed, of course, Republican prosecutors; but these prosecutors have found their hands tied by the legal requirement that jury panels must be drawn by the sheriff and the jury commissioner, both county officials. The sheriff in Hudson County is always an organization man, and while the law requires that the jury commissioner and the sheriff cannot both be members of the same political party, a Hague Republican can usually be found for the office of jury commissioner.

Mayor Hague has never been able to complete his control of his state, although he could say with justice that no other American boss who was unable to elect a majority of the legislature ever succeeded in a state government as well as he has. The legislature really does not matter much to him when it is shorn by the courts of its power to investigate. He is secure with his governors, judges, and commissioners.
